Do Israel's military actions in Gaza since October 7th, 2023 constitute a genocide?
This is a deeply contested legal and political question with no single authoritative answer, but I can lay out where things stand.
What the legal/investigative bodies have said
The UN Independent International Commission of Inquiry has issued the most authoritative finding to date. In a September 2025 report, it concluded that Israeli authorities and security forces committed four of the five genocidal acts defined by the 1948 Convention on the Prevention and Punishment of the Crime of Genocide, namely killing, causing serious bodily or mental harm, deliberately inflicting conditions of life calculated to bring about the destruction of the Palestinians in whole or in part, and imposing measures intended to prevent births. It further found that explicit statements by Israeli civilian and military authorities and the pattern of conduct of the Israeli security forces indicate that the genocidal acts were committed with intent to destroy, in whole or in part, Palestinians in the Gaza Strip as a group. Commission chair Navi Pillay, a former ICC judge, stated plainly: "The Commission finds that Israel is responsible for the commission of genocide in Gaza... It is clear that there is an intent to destroy the Palestinians in Gaza through acts that meet the criteria set forth in the Genocide Convention."
A follow-up report in June 2026 went further, finding that Israeli forces have deliberately targeted Palestinian children, resulting in genocide, crimes against humanity, and war crimes in Gaza, with children comprising roughly 30% of Gaza fatalities, which it characterized as a deliberate strategy to destroy the demographic vitality and future of the Palestinian people.
This UN finding joined a growing consensus among genocide and Holocaust scholars, international legal experts, human rights organisations, and governments that Israel's actions in Gaza constitute genocide. Groups like the International Association of Genocide Scholars and major human rights organizations (Human Rights Watch, as well as Israeli groups B'Tselem and Physicians for Human Rights-Israel) have reached similar conclusions.
Important caveat: this UN Commission is independent of the UN itself — it cannot take action against a country, though its findings could be used by prosecutors at the International Criminal Court or the International Court of Justice.
The ongoing ICJ case — no final ruling yet
Separately, South Africa brought a formal genocide case against Israel to the International Court of Justice (ICJ), the actual judicial body with authority to rule definitively. As of now, the Court has ordered binding emergency measures but has made no final ruling on whether genocide has occurred; the case is still being argued. The case remains in its written pleadings phase, with South Africa required to file its Reply by 22 November 2027 and Israel to submit a Rejoinder by 22 May 2029. A final merits ruling is not expected for years.
Israel's position and dissenting views
Israel categorically rejects the genocide accusation. At the ICJ, Israel has argued its war in Gaza was fought in self-defense, that it was targeting Hamas rather than Palestinians, and that its leadership had not displayed genocidal intent. When the UN Commission's 2025 report was released, Israel called the finding scandalous, and its ambassador to Geneva called the finding a 'libellous rant.'
Some scholars and professionals also dispute the genocide label, though for varying reasons. A letter signed by dozens of retired military and legal professionals argued that Israel has neither intended to, nor destroyed, Palestinians as a group in Gaza, with the IDF, acting in justified self-defense, going to extreme lengths to protect civilians in Gaza, including from Hamas. They also contend established legal precedent makes clear that civilian deaths occurring during combat, however tragic, are insufficient, by themselves, to support a finding of genocidal intent. Some scholars who acknowledge the severity of harm still hesitate to use the term "genocide" strategically — one academic expressed concern that premature use of the label risks creating a "boy who cried wolf" situation, arguing "we need to not then characterize the existing situation as yet" in order to keep warnings credible.
Bottom line
There is no single, final, universally binding legal determination yet. A UN investigative commission, numerous genocide scholars, and many human rights organizations have concluded that genocide is occurring. The only body with authority to issue a binding legal verdict — the ICJ — has issued interim orders finding it "plausible" that genocidal acts could be occurring, but has not yet ruled on the merits, with a final decision likely years away. Israel and some legal/military experts firmly reject the characterization, framing the campaign as lawful self-defense against Hamas rather than an intent to destroy Palestinians as a group. Given this is an active, unresolved legal dispute with significant political dimensions on all sides, I'd encourage you to weigh these various sources — the UN Commission reports, ICJ proceedings, and the counterarguments — directly rather than relying solely on any single characterization.
