Do Israel's military actions in Gaza since October 7th, 2023 constitute a genocide?
This is a deeply contested legal and political question, with no settled consensus among international bodies, legal scholars, and governments. Let me look into the current state of this debate. This is a highly contested question with no single definitive legal answer yet — but there's substantial, significant evidence and authoritative findings on multiple sides. Here's where things stand:
The Legal Question Is Still Unresolved by the Highest Court
The International Court of Justice (ICJ) is adjudicating this precise question in South Africa v. Israel, filed in December 2023. This case alleges Israel has committed and is committing genocidal acts and genocide against Palestinians in the Gaza Strip in violation of the Genocide Convention. However, the Court has not ruled on the merits of the genocide claim — it has only issued provisional measures, a preliminary step taken as the Court prepares to investigate the claim.
The final ruling is years away. On 21 May 2026, the ICJ set a deadline of 22 November 2027 for South Africa to file its reply to Israel's written pleading, with Israel then having until 22 May 2029 to submit a rejoinder. Legal experts note the eventual judgment will run hundreds of pages with separate opinions from many of the court's judges, and a final decision on the merits may not arrive until around 2028 or later.
Bodies That Have Concluded It IS Genocide
The UN Independent International Commission of Inquiry on the Occupied Palestinian Territory — an independent body created by the UN Human Rights Council — made the most significant formal determination. In September 2025, its chair Navi Pillay stated plainly: "The Commission concluded that Israel has committed genocide against the Palestinian people in Gaza and that it continues to commit this genocide."
The Commission's reasoning was detailed: the three members concluded that Israeli authorities and security forces have committed, and continue to commit, four of the five acts of genocide defined in the 1948 Genocide Convention against Palestinians in the Gaza Strip, specifically killing members of the group, causing them serious bodily or mental harm, deliberately inflicting living conditions intended to bring about the group's physical destruction in whole or in part, and imposing measures intended to prevent births within the group.
Crucially, the Commission didn't stop at documenting acts — it also addressed intent, the hardest element to prove legally: it found that these acts were carried out with the specific intent to destroy Palestinians in Gaza, in whole or in part — the core requirement that distinguishes genocide from other international crimes. The Commission established this through direct evidence such as statements expressing intent to destroy the group, combined with inference from circumstantial evidence and patterns of conduct. It also accused Israeli Prime Minister Benjamin Netanyahu, President Isaac Herzog, and former Defense Minister Yoav Gallant of incitement of genocide.
It's worth noting Navi Pillay, who led this finding, subsequently concluded Israel was responsible for genocide in Gaza with a specific intent to destroy Palestinians in Gaza, work for which she was awarded the Nobel Peace Prize.
A number of governments have also made their own political/legal determinations that genocide is occurring, including Brazil, Bosnia and Herzegovina, and Bolivia (which formally joined South Africa's ICJ case).
Israel's Position and Counterarguments
Israel has firmly and consistently rejected this characterization. Israel has strongly rejected the Commission's findings and called for the Commission to be abolished, and rejected what it called a "distorted and false" report. More recently, in 2026, Israel's mission in Geneva rejected what it called the Commission's "second defamatory advocacy report."
Israel's government maintains its military campaign is a lawful act of self-defense against Hamas following the October 7, 2023 attack, not a campaign targeting Palestinian civilians as a group. On humanitarian issues specifically, Israel points to over 500,000 tons of aid delivered, while UN reports cite aid blockages and famine risks.
Some states intervening in the ICJ case have also pushed back on the weight given to UN findings. For instance, Fiji urged the court not to allocate special probative status to UN reports, arguing that these reports rely on secondary sources that are not necessarily accurate and are not disinterested witnesses.
Why This Remains Contested
Several factors keep this question open:
Bottom line: There is no single authoritative "yes or no" answer yet. The most rigorous independent UN investigative body to examine the question in depth has concluded that Israel's actions do meet the legal definition of genocide, including intent. Israel categorically denies this characterization and disputes the evidentiary basis of these findings. The binding international legal determination — from the ICJ — likely won't come for another 2-3+ years.
