Do Israel's military actions in Gaza since October 7th, 2023 constitute a genocide?
This is a deeply contested question that different authoritative bodies have answered differently, and no court has yet issued a final, binding ruling. Here's where things stand:
No final legal determination exists yet
The ICJ case brought by South Africa (filed December 2023) is still in its preliminary stages. Following a request by Israel, the court on 14 April 2025 extended the time for submission of Israel's counter-memorials to 12 January 2026, and it is likely that Israel will file preliminary objections regarding jurisdiction. Given these lengthy procedures, it is unlikely that the final judgement in the case will be handed down before 2028. The ICJ has only ruled on provisional measures, finding in January 2024 that it was plausible that Israel's acts could amount to genocide, issuing provisional measures ordering Israel to take all measures within its power to prevent genocidal acts — this is a much lower threshold than a final merits ruling.
Bodies that have concluded it is genocide
The UN's Independent International Commission of Inquiry, after two years of investigation, concluded in September 2025 that "Israel is responsible for the commission of genocide in Gaza," with "an intent to destroy the Palestinians in Gaza through acts that meet the criteria set forth in the Genocide Convention." The commission found Israel has "committed four genocidal acts" in the enclave since October 7, 2023, including killing Palestinians, causing serious bodily and mental harm, deliberately inflicting conditions of life calculated to destroy the group, and imposing measures intended to prevent births within the group. More recent reports from mid/late 2026 have reiterated these findings, with the Commission stating Israeli forces continue to commit genocidal acts even after the so-called ceasefire agreement, with the intent to destroy the Palestinian people, in whole or in part.
Additionally, the International Association of Genocide Scholars, in September 2025, passed a resolution declaring that Israel is committing war crimes, crimes against humanity and genocide in Gaza. Various UN special rapporteurs and human rights organizations like Oxfam have also used genocide framing.
Israel's rejection and Western government positions
Israel has firmly and consistently rejected these characterizations. The Israeli government has maintained it is conducting the war in Gaza in self-defense and in accordance with international law, firmly denying accusations of genocide, with the foreign ministry stating Israel "categorically rejects the distorted and false report." Israeli officials have called the UN Commission's findings a "cherry-picked" narrative that "falsely accuses Israel of genocidal intent, an allegation it cannot substantiate."
Many Western governments have avoided making their own legal determination. For example, a UK government spokesman said that the determination as to whether Israel's actions constitute genocide was up to a court, though it stated that "Israel's actions are appalling." Germany has actively opposed the genocide characterization, with Germany's Vice Chancellor saying Israel was not committing genocide in Gaza, and the Foreign Minister saying the Gaza war should be characterized as "self-defence," not genocide.
Bottom line
There is no single authoritative "yes or no" answer. A UN-mandated commission of inquiry, genocide scholars' association, and several human rights bodies have concluded genocide is occurring, based on patterns of killing, mass civilian harm, deliberate deprivation of humanitarian aid, and statements by Israeli officials they interpret as evidence of genocidal intent. Israel and some Western governments reject this characterization as unsubstantiated or politically motivated, framing the conflict as self-defense against Hamas within the bounds of international law. The only body with binding authority to make a definitive legal ruling—the ICJ—has so far only found the genocide allegation "plausible" enough to warrant provisional measures, and a final merits judgment is likely years away (possibly not before 2028).
Given the gravity and contested nature of the term "genocide," I'd encourage looking directly at primary sources — the UN Commission's full report, Israel's official responses, and ICJ filings — rather than relying solely on secondary characterizations.
