Do Israel's military actions in Gaza since October 7th, 2023 constitute a genocide?
This is one of the most contested legal and political questions of our time, with serious, well-informed people and institutions landing on different sides. Let me lay out where things stand rather than simply declaring a verdict, since that itself is part of the controversy. There's no single settled answer—this remains genuinely contested on both factual/legal and political grounds, though the weight of expert opinion has shifted significantly over the course of the war. Here's where things actually stand:
The case that it does constitute genocide
Institutional findings: In September 2025, the UN Independent International Commission of Inquiry on the Occupied Palestinian Territory concluded that Israel has committed genocide against Palestinians in the Gaza Strip. The Commission found Israel guilty of four out of five acts specified in Article 2 of the 1948 Genocide Convention against Palestinians—murder, causing serious bodily or mental harm, deliberately inflicting conditions of life calculated to destroy the group, and imposing measures to prevent births—and found statements by senior Israeli officials alongside other evidence sufficient to establish genocidal intent. It specifically concluded that Israeli President Isaac Herzog, Prime Minister Benjamin Netanyahu and then Defence Minister Yoav Gallant have incited the commission of genocide. A follow-up report in June 2026 found Israeli authorities and security forces have deliberately targeted Palestinian children, resulting in genocide and atrocity crimes in the Gaza Strip.
Academic consensus has shifted sharply. In August 2025, the International Association of Genocide Scholars, a 500-member body of academics founded in 1994, passed a resolution stating that Israel's policies and actions in Gaza fulfil the definition of genocide set out in the 1948 Genocide Convention, with 86% of IAGS members voting in favour. More broadly, Holocaust scholar Shmuel Lederman said that from mid-2024 there was broad agreement among those genocide scholars who expressed views on this that Israel's actions constitute genocide, and by May 2025, NRC wrote that leading scholars in genocide studies are "surprisingly unanimous" that Israel is committing genocide. This includes Israeli scholars: Raz Segal called the assault on Gaza "a textbook case of genocide unfolding" as early as October 2023, while Omer Bartov, a professor of Holocaust and genocide studies who had previously served in the Israeli Defense Forces, reached the "inescapable conclusion" in July 2025 that Israel is committing genocide. Israeli human rights groups have also joined this: two influential Israeli NGOs recognized the genocide in Gaza in July 2025, with B'Tselem detailing unlivable conditions, attacks on institutions, and mass killings in a report titled "Our Genocide".
Proceedings: South Africa's case against Israel is before the ICJ (South Africa v. Israel), alleging that Israel "has failed to prevent genocide and has failed to prosecute the direct and public incitement to genocide," and that Israel "has engaged in, is engaging in and risks further engaging in genocidal acts against the Palestinian people in Gaza". The court has issued provisional measures but has not yet ruled on the merits, with the written phase expected to run until around 2029.
The case against the genocide characterization
Israel and its allies reject this firmly. Israel's position, as argued before the ICJ, is that it was engaged "in a war it did not start and did not want," rejecting accusations of genocidal intent, and that its military campaign is aimed at dismantling Hamas and removing the terrorist threat—not destroying the Palestinian people. Israel argues it has taken steps to reduce civilian harm and facilitate humanitarian aid while fighting an enemy that operates from within densely populated civilian areas, and that international law permits military operations against legitimate targets even when civilian casualties are expected, provided the harm is not clearly excessive relative to military advantage.
The US, Germany, and UK governments have declined to label it genocide, generally taking the position (echoed by UN spokespeople) that "labelling of an event as a genocide is up to a competent legal authority" rather than governments or commissions. A UK spokesperson said the determination as to whether Israel's actions constitute genocide was up to a court, though "Israel's actions are appalling". US President Trump has also stated he does not believe genocide is occurring.
Some legal scholars also dispute the characterization on narrower technical grounds — for instance, scholar Stefan Talmon said Israel was not committing genocide in Gaza, but said Israel had committed war crimes, and legal scholar Samuel Estreicher argued it was not a case of genocide, but that Israel's actions were commensurate with war crimes or crimes against humanity.
The actual legal status
Importantly: no court has yet issued a binding ruling that genocide occurred. The UN Commission of Inquiry's finding, while significant and a crucial source of evidence for the ICJ in making its determination of Israeli responsibility under the Genocide Convention, is not a binding legal ruling. The ICJ case represents the most significant legal challenge to Israel's conduct, as the court's eventual ruling on whether genocide occurred would be binding under international law, but that ruling remains years away.
My honest take
Given the above, I won't pretend there's a neutral, uncontested answer — doing so would misrepresent the state of the debate. What I can say: the burden of expert opinion (genocide scholars, international law scholars, UN human rights bodies, major human rights organizations, and even some Israeli institutions) has moved substantially toward concluding genocide has occurred, particularly as the war has continued and documentation has accumulated. But the authoritative legal determination — a binding ICJ ruling — has not yet been made, and Israel along with several major Western governments continue to reject the characterization, arguing it conflates wartime civilian suffering and self-defense with specific genocidal intent. Where you land likely depends on how you weigh expert/scholarly consensus against the requirement for formal judicial adjudication, and how you interpret statements by Israeli officials as evidence of intent versus rhetoric.
