Do Israel's military actions in Gaza since October 7th, 2023 constitute a genocide?
This is a deeply contested question where credible legal bodies, scholars, and institutions disagree. Let me look at the current state of findings and arguments. This is one of the most contested legal and political questions of the current era, and the honest answer is: it depends on which authority you ask, and the matter has not been legally resolved with finality. Here's where things stand:
Formal findings alleging genocide
UN Commission of Inquiry (OHCHR/HRC): In September 2025, the UN Independent International Commission of Inquiry on the Occupied Palestinian Territory concluded that Israel has committed genocide against Palestinians in Gaza and that the country's top leaders have incited genocide, finding that Israel "committed four genocidal acts" including killing, causing serious bodily and mental harm, deliberately inflicting conditions of life calculated to destroy the group, and imposing measures intended to prevent births within the group.
The Commission specified the acts in detail: killing and seriously harming unprecedented numbers of Palestinians; imposing a total siege, including blocking humanitarian aid leading to starvation; systematically destroying the healthcare and education systems in Gaza; committing systematic acts of sexual and gender based violence; directly targeting children; carrying out systematic and widespread attacks on religious and cultural sites; and disregarding the orders of the International Court of Justice. On intent, the Commission applied the "only reasonable inference" standard set forth by the International Court of Justice in Bosnia v. Serbia, analyzing statements made by Israeli authorities and concluding those statements are direct evidence of genocidal intent.
Subsequent reports (June and October 2026) have reaffirmed and extended this finding, with the Commission stating Israel had kept committing "genocidal acts with the genocidal intent to destroy, in whole or in part, the Palestinians in Gaza" even after the October 2025 ceasefire.
The International Court of Justice (ICJ) — the body that could make a binding legal ruling
South Africa filed a case against Israel in December 2023 concerning alleged violations by Israel of the Genocide Convention, contending that Israel had failed to prevent genocide, failed to prosecute incitement to genocide, and had engaged in genocidal acts against the Palestinian people in Gaza. Importantly, this case is still ongoing and has not reached a final merits judgment. The Court has only issued provisional (emergency) measures, finding it plausible that Israel's acts could amount to genocide and ordering Israel to take preventive measures. Crucially, as the ICJ itself has clarified, at the provisional measures stage, the Court does not determine the merits of the case — it has yet to make a determination whether Israel has committed, sanctioned, or incited genocide. A hearing on the merits will be held at a later stage. That merits ruling, which would carry real legal weight, is still years away, with memorials and counter-memorials being filed through 2025 and 2026.
Israel's position
Israel has firmly rejected the genocide characterization. It has characterized South Africa's charges as "baseless," accusing the country of "functioning as the legal arm" of Hamas, and maintained that it was conducting a war of self-defense in accordance with international law following the Hamas-led attack on 7 October 2023. Regarding the UN Commission's 2025 report, Israel's foreign ministry stated "Israel categorically rejects the distorted and false report and calls for the immediate abolition of the Commission of Inquiry," describing it as a "report that relies entirely on Hamas falsehoods" and accusing the authors of being proxies for Hamas. Israel has also long accused the UN Human Rights Council, which set up the commission, of anti-Israel bias, and the Trump administration has backed Israel, withdrawing from the UN body in 2018 and again during the first month of Trump's second term.
Other institutional positions
Reactions from governments have varied. The UK government has notably declined to make its own determination, with a spokesman saying that the determination as to whether Israel's actions constitute genocide was up to a court, though it stated that "Israel's actions are appalling." Brazil, while supporting South Africa's ICJ case and some of the Commission's recommendations, referenced the report saying human rights violations in Gaza "must be investigated" but did not explicitly affirm support for the Commission's genocide allegation, while voicing support for a permanent ceasefire and unimpeded humanitarian aid access.
Bottom line
Given the gravity and contested nature of the term, this is ultimately a question where reasonable people, states, and institutions have reached different conclusions based on the same underlying facts, and the final legal determination remains pending.
